<strong>Oriana Garcia pled guilty to first-degree child abuse, faces up to 20 years in jail</strong></h6>
<p>A Hagerstown Maryland woman has pleaded guilty to first-degree child abuse in the beating death of her 9-year-old son over a missing piece of birthday cake.<br />
Prosecutors agreed to drop a second-degree murder charge and seek a sentence of no more than 20 years for 27-year-old Oriana Garcia, who appeared Wednesday in a Hagerstown courtroom.<br />
Garcia’s son Jack was handcuffed and chained him to a dining-room chair by Garcia’s brother and pummeled by her boyfriend, who suspected Jack of eating cake meant for his 2-year-old daughter.<br />
Police say Oriana Garcia, allowed the abuse and delayed treatment by sending away an ambulance, as her son lay dying. When medics arrived again several hours later, Jack was unconscious.</p>

<p>Jacob Andrew Barajas shackled his nephew prior to the beating by 31-year-old Robert Wilson who inflicted trauma that left the child with bruises over most of his body and brain injuries that proved fatal.<br />
The boy died July 5 at Children’s National Medical Center in Washington, D.C., after he was taken off a ventilator.<br />
During the trial, Assistant State&#8217;s Attorney Sarah Mollett-Gaumer said Gracia&#8217;s brother Jacob Barajas, who had been the one to initially call 911, emphasized: &#8220;every single decision &#8230; was something we all decided and agreed upon,&#8221; Mollett-Gaumer said.<br />
The court heard that Barajas called 911 after Garcia became unconscious. But when a Community Rescue Service ambulance arrived at about 5 p.m., Oriana Garcia allegedly turned the crew away, saying her son was congested, but was getting better.<br />
It was not until four or more hours later that Wilson called for an ambulance, and the unresponsive boy was taken to Meritus Medical Center near Hagerstown. There, it was determined that the extent of his injuries required taking him to the Children’s National Medical Center.<br />
Barajas also said, Mollett-Gaumer added, that boy was often handcuffed for several hours after previous accusations he had stolen food.</p>

<p>Robert Wilson, 31, is serving 30 years in prison, guilty of beating Jack Garcia to death over a missing slice of birthday cake. Wilson, boyfriend to the victim&#8217;s mother, laid some of the blame on his girlfriend Oriana Garcia and her brother Jacob Barajas, both of whom also face second-degree murder charges.<br />
Oriana Garcia and Wilson first struck up a relationship online while she was living in California. They later met at an airport in Pittsburgh before she, Barajas and her son Jack moved in with Wilson about three months before the boywas killed.</p>

<p>Jack&#8217;s uncle Jacob Andrew Barajas, brother to Oriana Garcia, handcuffed his nephew to a chair to be subjected to a brutal beating that led to his death on the suspicion of sneaking a piece of birthday cake. Jack died from injuries sustained have been and he pled guilty to first-degree child abuse. He is awaiting sentencing. for the offense which carries a maximum penalty of 25 years.</p>
