Daniel Sparber is accused of beating a woman he robbed, leaving her with a black eye and needing stitches to close a head wound after the Hell’s Kitchen attack.<br />
The suspect also has a criminal record that includes a 15-year prison sentence for slashing a young couple at a nightclub. As a matter of fact, Sparber&#8217;s current defense posture is quite reminiscent of his unsuccessful <a href="http://law.justia.com/cases/new-york/other-courts/2008/2008-51737.html">2002 motion to withdraw an earlier previously entered plea of guilty</a> to the crime of Assault in the First Degree in the night club slashing suit. his motion was died by the court.<br />
Still Sparber argues he’s the one who suffered. In the current felony assault case,<br />
Sparber, 43, was arrested after he allegedly followed a woman into the Westfield Marketplace on Tenth Ave. NT around 1:30 a.m. on May 9, 2016.<br />
According to the arrest documents, he shoved her to the ground and walked out with her cell phone, then returned and punched her twice in the head, Cops said.<br />
The victim suffered “substantial pain,” was treated at Mount Sinai West Hospital.<br />
Sparber was arrested during a parole visit nearly four months after finishing a<a href="http://law.justia.com/cases/new-york/other-courts/2008/2008-51737.html"> 15-year prison sentence for the 2001 nightclub slashing.</a><br />
However, in pre-trial motions Sparber’s attorney, Joseph Bondy, argued that the cops had it all wrong and that there should have been surveillance footage to prove it from inside the store.<br />
A friend of Sparber’s, Manuel Reyes, submitted a sworn affidavit saying that a woman named “Donna” approached him and Sparber asking for a “bump of cocaine,” which he didn’t give her.<br />
“At some point near the corner of 48th and 10th Ave., I observed the two of them in what initially appeared to be hugging, and then saw ‘Donna’ shoving Mr. Sparber,” Reyes wrote.<br />
Later, Sparber realized his gold chain was gone and when they returned to the spot, they found the medallion that had been on the chain, the friend wrote. Reyes said Sparber believed Donna had taken the chain. The &#8216;witness&#8217; Reyes, admits he did not see what happened inside the store.<br />
Sparber was arrested on June 6, 2016, about a month after the incident. The seemingly flustered when parolee told cops: “I didn’t do anything,” he said. “I was assaulted and robbed.”<br />
Trial is scheduled to begin in Manhattan Supreme Court, this week.<br />
On Feb., 10 In 2001 Daniel Sparber, 27, left 19-year-old Jessica needing about 300 stitches because of his unhinged razor blade attack when she rejected his repeated invitation to dance in the second-floor lounge of a Manhattan dance club. He also nearly severed her boyfriend’s right ear. The victim was out on a date celebrating her birthday at the nightclub. Eric Garcia, 21, himself needed 100 stitches to re-attach his almost severed ear as he came to the rescue of his girlfriend during the assault.<br />
Joseph Bondy, Sparber’s attorney has suggested the jury might hear Sparber’s tables-turned theory.<br />
“The evidence supports that defense because it’s the truth,” Bondy said. “The truth of the matter is he was the victim of a crime. He didn’t intentionally rob or assault anybody.”<br />
Sparber is facing another 15 years behind bars on the robbery account. He also faces counts of second-degree attempted assault and third-degree assault.</p>
