<div class="artSplitter mol-img-group">The trial of a former St Louis police officer charged with murder in the 2011 shooting death of a suspect begins on Tuesday.<br />
Jason Stockley, 36, is accused of fatally shooting Anthony Lamar Smith, 24, five times after a high-speed chase in December 2011.<br />
The verdict in this case will be decided by St Louis Circuit Judge Timothy Wilson after Stockley waived his right to a jury trial.<strong> </strong></div>

<p class="mol-para-with-font">The court will hear opening statements beginning on Tuesday with prosecutors expected to introduce the evidence of footage from the police dashboard camera inside Stockley’s squad car, showing the cop brandishing his personal AK-47 while on duty and telling his partner he was going to kill [the victim] Smith.<br />
Stockley later told internal affairs investigators he shot Smith five times with his service weapon because he believed the man was reaching for a handgun, but the only firearm found in Smith&#8217;s vehicle had Stockley&#8217;s DNA on it.<br />
The judge presiding over the trial has imposed a gag order on all the participants in the case and no cameras will be allowed inside the courtroom, reported <a class="" href="http://stlouis.cbslocal.com/2017/07/31/former-st-louis-police-officer-stands-trial-for-murder/" target="_blank" rel="nofollow noopener">KMOX</a>.<br />
Stockley&#8217;s case marks the first time in two decades that a St Louis law enforcement officer has been charged with murder while on duty.<br />
Stockley was charged in May 2016 with first-degree murder and armed criminal action in the December 20, 2011, death of Smith, a black man who was a drug suspect.</p>

<p class="mol-para-with-font">Videos from Stockley&#8217;s police SUV and store surveillance footage obtained by the St. Louis Post-Dispatch in September 2016 shed new light on the fatal officer-involved shooting.<br />
Stockley and Officer Brian Bianchi pulled up behind Smith&#8217;s rented car outside of a fast food restaurant in early afternoon on December 20, 2011, the dashcam and surveillance camera videos show.<br />
Smith backs into the police SUV, maneuvers out of the parking lot and speeds past Stockley, who is not in the SUV, nearly knocking an AK-47 rifle from his hands. It was Stockley&#8217;s personal rifle; officials say carrying that on duty is against department policy.<br />
Stockley fired several shots from his department-issued handgun, and the two officers began the chase. Court documents accuse Stockley of saying during the chase, &#8216;Going to kill this mother****er, don&#8217;t you know it.&#8221;</p>

<p class="mol-para-with-font">After Smith&#8217;s car stops, Stockley tells Bianchi to ram the rear. The officers get out and Stockley fires five shots from his service pistol into the car. There is no audio of the officers&#8217; voices outside their SUV.<br />
Stockley, now 36, told investigators he fired after Smith reached for a gun, then unloaded Smith&#8217;s gun as a safety precaution after the shooting.<br />
The shooting was originally ruled justified after a .38-caliber Taurus revolver was found on Smith&#8217;s body, but prosecutors claim the gun only had Stockley&#8217;s DNA on it, leading Smith&#8217;s relatives and supporters to believe Stockley planted the weapon.<br />
&#8216;Anthony didn&#8217;t have a gun with him that day, and if he had a gun, it wouldn&#8217;t be that revolver,&#8217; Smith&#8217;s fiancée, Christina Wilson, told <a class="" href="http://www.stltoday.com/news/local/crime-and-courts/st-louis-prosecutor-former-police-chief-at-odds-over-timing/article_782cb8bb-57e2-531a-8af5-698f3ad40ea7.html" target="_blank" rel="nofollow noopener">St Louis Post-Dispatch</a> last year. &#8216;That&#8217;s just not a gun that any young guy is going to carry.&#8217;</p>

<p class="mol-para-with-font">A federal judge has prohibited release of the videos and police reports by lawyers who obtained it as part of a civil case in which the St. Louis Board of Police Commissioners paid a $900,000 settlement for Smith&#8217;s young daughter.<br />
Stockley left the force in 2013 and is free on $1million bond secured by the St. Louis Police Officers&#8217; Association. Bianchi was not accused of wrongdoing and is still on the force.<br />
Stockley&#8217;s bench trial is expected to last two weeks.</p>
