Barry Wells in court. Wells allegedly, Wells confessed to murdering his wife over the Christmas, after getting into a fight about her staying in a shelter and his cheating

Tonie Wells, 22, was found dead at the bottom of a stairwell inside the couple’s Crown Heights home on Dec. 27.
The dead Brooklyn mom was discovered inside her apartment building an hour after two cops failed to respond to a 911 call. The city medical examiner ruled that she was strangled. – Officially ruling her death a homicide cleared the way for prosecutors to seek upgraded charges against her husband.
The victim’s husband, Barry, was taken into custody for a psychological evaluation, and held without bail on Rikers Island, charged with aggravated family offense for violating an order of protection. He is now charged with her murder.

The victim’s family let loose at her husband in court on Thursday

Wells was recently pregnant, but suffered a miscarriage after a domestic quarrel, a cousin revealed. This was confirmed by a police source who said Wells was eight months pregnant when she lost her baby a month earlier.
An hour earlier, the doomed woman was heard screaming in the background of a 911 call from a family member. “He’s going to kill me,” Tonie Wells shrieked, according to sources.
But the responding officers, identified as Wing Hong Lau and Wael Jaber, left the scene without even stepping out of their car on the bitter cold morning.
Lau, 47, and the 42-year-old Jaber, both 11-year veterans.\ were later castigated for their actions by Police Commissioner James O’Neill.
“I always speak to how proud I am of our officers, but unfortunately when we don’t live up to that standard we have to fully investigate,” O’Neill said. The matter has been referred to Internal Affairs is for investigation.
Through his lawyer, Barry Wells pleaded not guilty to second-degree murder charges in the brief court appearance marked by a series of angry outbursts.
But he told police and prosecutors that he had everything to do with the killing of his young wife, according to court papers.

Barry Wells was arrested in the death of his wife, and placed under psychiatric observation after telling cops he wanted to kill himself

In two separate interviews, Wells told investigators that he had started seeing other women because his wife had an order of protection against him.
The pair started fighting at the entrance to the apartment at about 8 a.m. Their 2-year-old daughter was left outside as the brawl moved into the home, he said.
“Tonie was swinging at him and he grabbed her and brought her inside the apartment,” according to court papers summarizing Wells’ statements.
“Then he grabbed her by the neck and they ended up by the basement door.”
Wells told police she fell down the stairs and was gasping for air.
Even though he knows CPR, he didn’t perform it on his dying wife, court papers say.
Instead, Wells checked her pulse and then fled after realizing that she was dead, the documents say.
The suspect was later overheard telling his grandmother, “I can’t do this. I killed my wife,” according to court documents.

Wells, who was hospitalized after his arrest, kept his head down throughout the proceeding at Brooklyn Supreme Court.
He was ordered held without bail.As Wells was led out of the courtroom in handcuffs, his wife’s family showered him with verbal barbs.
“Motherf—-r, you’re going to die in hell,” one yelled.
“He’s gonna rot,” hollered another.
Both responding officers are suspended, and the victim’s mother has filed court papers signaling her plan to sue the city.
Elizabeth Rivera filed a petition in Manhattan Supreme Court asking that a judge order the NYPD to turn over 911 tapes, police logs and other documents.
Information on Jaber and his partner, Lau’s botched response is necessary for Rivera’s anticipated wrongful death lawsuit against the city regarding her 22-year-old daughter’s death, she said in documents.

A March 29 video on Wells’ Facebook page showed her husband delivering a bag of takeout food that actually held an engagement ring.
The two were married less than two weeks later.
Over the summer, Wells got his wife’s face tattooed on his back.
