<p class="mol-para-with-font">State legislators in West Virginia voted to bring impeach charges against the entire state Supreme Court after accusing the justices of multiple crimes, including lavish spending on office decorations that cost tax payers $3.7 million.<br />
The articles of impeachment recommend the four justices be impeached &#8216;for maladministration, corruption, incompetency, neglect of duty, and certain high crimes and misdemeanors.&#8217;<br />
&#8216;It&#8217;s a sad day, and it certainly isn&#8217;t a cause for celebration,&#8217; said Republican lawmaker John Shott, the chairman of the Judiciary Committee handling the issue, according to the <a class="class" href="https://www.wvgazettemail.com/news/politics/wv-house-committee-approves-articles-of-impeachment-against-justices/article_f4795b83-ba20-5ac8-a267-aeb4b10060fa.html" target="_blank" rel="nofollow noopener">Charleston Gazette-Mail</a>.</p>

<div>The full state House will begin deliberations on the matter Monday.<br />
If House lawmakers approve the impeachment charges, it goes to the state Senate for trial.<br />
The situation has left the future of court uncertain ahead of an August 14 deadline to set a special election if one is needed to fill any vacancies.<br />
The West Virginia Supreme Court has five justices elected to 12-year terms. But it is down to four after Justice Menis Ketchum abruptly announced his retirement as impeachment proceedings were set to begin, consequently he was not a subject of impeachment.<br />
The remaining four justices are facing 14 articles of impeachment, including a charge of &#8216;unnecessary and lavish&#8217; spending of taxpayer dollars to renovate their offices in the East Wing of the state Capitol building.<br />
It was reported the justices spent $3.7 million in taxpayer funds on the project, including a $32,000 suede couch and $1,700 in throw pillows for Justice Allen Loughry&#8217;s office, the <a class="class" href="https://wchstv.com/news/waste-watch/waste-watch-investigation-wv-supreme-court-spending-examined" target="_blank" rel="nofollow noopener">local CBS TV station</a> revealed; along with a wood floor inlaid with a design in the shape of the state of West Virginia.</div>

Justice Allen Loughry faces further charges related to his alleged use of state vehicles for personal travel and keeping state property in his home.<br />
He is also accused of having personal photos, documents, and artwork framed at the cost to taxpayers expense and issuing an order authorizing payments to retired judges in excess of what is allowable under state law.<br />
Loughry allegedly moved a valuable and historic &#8216;Cass Gilbert&#8217; desk from the Capitol building to his home office. &#8211; Gilbert was the architect of the Capitol building.</p>

According to state law, if a justice leaves or is removed from office 84 days prior to a general election, the governor appoints an interim justice and voters pick a new justice during the November contest.<br />
August 14 is the 84 day mark.<br />
If a justice leaves or is removed after August 14, the governor still appoints an interim justice but the special election moves to May 2020.</div>

<p class="mol-para-with-font">But some state Democrats are charging Republican lawmakers with a &#8216;coup,&#8217; delaying impeachment proceedings to the point they would go past the August 14 deadline and letting the Republican governor fill the bench with his picks.<br />
Democratic Delegate Barbara Evans Fleischauer told <a class="class" href="https://www.npr.org/2018/08/08/636761241/west-virginia-house-panel-votes-to-impeach-entire-supreme-court" target="_blank" rel="nofollow noopener">NPR</a> she sees the timing of the impeachment as a ploy to allow Gov. Jim Justice to appoint the majority of the justices on court.<br />
&#8216;It&#8217;s a coup,&#8217; she said. &#8216;They dragged this out all summer long, and suddenly they put this on the agenda.&#8217;<br />
Republican lawmakers deny the charge.<br />
&#8216;In an election year, there&#8217;s going to be people who will spin it however it creates the most advantage to them. That&#8217;s just part of the process,&#8217; Shott told the <a class="class" href="https://www.wvgazettemail.com/news/politics/wv-house-committee-approves-articles-of-impeachment-against-justices/article_f4795b83-ba20-5ac8-a267-aeb4b10060fa.html" target="_blank" rel="nofollow noopener">Charleston Gazette-Mail</a>.</p>
