<p>A leading New York doctor and his designer wife last September threw a backyard party for his sister&#8217;s birthday at their home in Queens. <br>However the nine-course dinner to be ruined by &#8216;a racist&#8217; neighbor and a female accomplice who first invaded the home with a German Shepard, before the man &#8216;hosed&#8217; the guest and the caterers with water during a noise dispute, according to a lawsuit.<br>Dr Yves Duroseau, a New York physician, his wife Claude and more than a dozen of his guests allege that neighbor Marcus Rosebrock, a 48-year-old married father-of-two, violated their civil rights by attacking the group.<br>Yves, who in 2020 was the first physician in the U.S. to receive the COVID vaccine, and Rosevony, a U.S. Citizenship and Immigration Services [USCIS] asylum officer based out of Washington, D.C., are Haitian-American, and all but one of the guests at the gathering were Black or Latino.</p>

<p>A lawsuit brought by Duroseau and his guests, among whom were a top a music executive and several prominent lawyers, also alleges an unnamed woman, named as Jane Doe in the suit, threatened them with a German Shepherd dog during the incident.<br>Rosebrock, a German national, denies the allegations and &#8216;rejects any characterization that he is racist&#8217;, according to a statement from his lawyer.<br>The suit states that Duroseau, the current chair of Emergency Medicine at Lenox Hill hospital in New York City, threw a garden party on September 17, 2022, for his sister Rosevony Duroseau for her 47th birthday.</p>

<p>The birthday dinner was held in the yard of his Forest Hill home with around 15 guests, mostly black or Latino, according to the suit.<br>Guests included Rigo Morales, a record executive who has worked with Eminem and 50 Cent, along with lawyers and banking bosses. The suit said many of those present were friends Rosevony met at Fordham Law School.<br>They enjoyed a nine-course al fresco dinner cooked by TV chef Vanessa Cantave, who won the Bravo reality cooking competition Rocco&#8217;s Dinner Party in 2011.<br>At 9.50pm when the party was &#8216;winding down&#8217;, the female defendant known as Jane Doe &#8216;entered the Duroseau home uninvited with a large German Shepherd and demanded that the music playing in the backyard be turned down&#8217;, according to the lawsuit.<br>Cantave and her business partner, Shani Porter, feared the dog &#8216;would attack and seriously injure them as it appeared menacing and aggressive&#8217;. They went into the yard to inform Duroseau and his sister, who is a US Citizenship and Immigration Services asylum officer, about the complaint.<br>Dr Duroseau told the woman the party would be ending soon and requested that she leave his property, before he returned to his yard to continue socializing. </p>

<p>But soon after, Rosebrock, whose yard neighbors Duroseau&#8217;s, &#8216;took his water hose and began water hosing [the guests] in the Duroseau&#8217;s backyard to get them to disperse&#8217;, according to the suit.<br>The suit said the incident created &#8216;a scene reminiscent of 1960s Birmingham, Alabama, when white law enforcement officers used fire hoses to douse, assault and batter African Americans participating in civil rights demonstrations&#8217;.<br>The suit alleges Rosebrock increased the pressure of the hose during the alleged attack so that it was &#8216;extremely powerful and stinging in nature&#8217;.<br>Rosebrock allegedly subjected the group to a prolonged attack until they were &#8216;completely drenched.<br>Police were called and two NYPD officers responded to take a report, but there has been &#8216;no follow-up since then, even though this incident should be investigated as a hate crime&#8217;, according to Derek Sells, a lawyer representing the group.</p>

<p>When one guest tried in vain to “speak calmly” with Rosebrock to see if she could convince him to stop, he instead “turned his water hose on [her] at high intensity and viciously hosed her with water from head to toe,” according to the complaint.<br>Having wrecked the party, Rosebrock concluded the shocking episode by hosing down the caterer’s assistant as she cleared the dinner plates.<br>The Duroseaus called 911 to report the incident, and two NYPD officers showed up to take a report, according to their attorneys<br>“There has been no follow-up since then, even though this incident should be investigated and treated as a hate crime,” one of the family&#8217;s attorney&#8217;s said.</p>

<p>Now Yves and Claude Duroseau, along with all 15 guests, the caterer, and her sous chef, are now demanding Rosebrock fork over undetermined monetary damages for the mental anguish and emotional distress they say he and the dog lady, who is identified in the complaint as “Jane Doe,” caused them.<br>The suit accuses both Rosebrock and the woman of being &#8216;racist&#8217;.<br>The suit adds: &#8216;Each of the plaintiffs suffered economic losses as a result of [the defendants&#8217;] conduct.<br>&#8216;Unable to use their property for a peaceful gathering, and humiliated, put into fear, embarrassed and degraded, plaintiffs seek justice for the assaultive conduct, battery and civil rights violations&#8217;.<br>Duroseau and his sister are Haitian-Americans. The suit said they were &#8216;celebrating with family and friends, all of whom were black or Latino, except one&#8217;.<br>Lawyers for Duroseau and the 18 others named in the lawsuit told <a rel="noreferrer noopener" href="https://www.thedailybeast.com/white-neighbor-allegedly-hoses-down-prominent-black-dinner-party-guests?ref=home?ref=home" target="_blank">The Daily Beast</a>, which first reported the case: &#8216;I was appalled and disgusted that water hosing and German Shepherds were being used against people of color in New York City in 2022. I was in utter disbelief.&#8217;<br>Malik said the guests remain &#8216;deeply scarred&#8217; by the alleged ordeal and were &#8216;made to feel less than human&#8217;.<br>The civil rights claim in the suit said the incident violated Title 7 of the New York City Administrate Code.<br>Rosebrock&#8217;s attorney, Brandon Gillard, told The Daily Beast that he &#8216;denies any of the allegations in the complaint, and rejects any characterization that he is racist, or that his actions were racially motivated&#8217;.<br>The suit seeks unspecified financial damages. </p>
