<p>A judge has thrown out the top counts in Luigi Mangione’s state murder case, rejecting claims that the accused killer can be charged as a terrorist, in a huge blow to prosecutors.<br>In a ruling released Tuesday, Judge Gregory Carro tossed charges of murder in the first degree as an act of terrorism and murder in the second degree as a crime of terrorism against the Ivy League educated murder suspect.<br>The judge did keep alive Mangione’s other second-degree murder charge for allegedly assassinating UnitedHealthcare CEO Brian Thompson, last December.</p>

<p>The University of Pennsylvania alumni allegedly used a 3D-printed ghost gun equipped with a homemade silencer to execute Thompson outside a Hilton hotel in Manhattan where UnitedHealthcare’s parent company was holding its annual investor conference, on December 4, 2024.<br>The shooting was caught on surveillance camera footage.</p>

<p>The ruling means that the most serious charge Mangione is facing in December&#8217;s killing of healthcare executive Brian Thompson is a single count of murder in the second degree.<br>“The People presented sufficient evidence that the defendant murdered Brian Thompson in a premeditated and calculated execution. That does not mean, however, that the defendant did so with terroristic intent,” Judge Carro wrote in his decision.<br>Mangione is also accused of two counts of criminal possession of a weapon in the second degree, four counts of criminal possession of a weapon in the third degree, one count of criminal possession of a weapon in the fourth degree and one count of possession of a forged instrument in the second degree.<br>The decision is a huge legal win for Mangione and comes after his lawyers claimed prosecutors were rushing to bring the case against him.</p>

<p>Mangione still faces 25 years to life if he is convicted in the state case, but not the 25 years to life without the possibility of parole that he would be facing in the dropped charges. <br>Mangione also still faces separate federal murder related charges that carry a possible death penalty, unlike the state of New York where capital punishment was been abolished in 2004.<br>Carro handed down the case shifting ruling during a 15-minute hearing in Manhattan Supreme Court on Tuesday morning.<br>Mangione appeared at Manhattan Supreme Court dressed in khaki colored prison issue uniform, shackled and handcuffed as he made his way into the courtroom.</p>

<p>Manhattan District Attorney Alvin Bragg was “wildly overcharging” Mangione in an attempt to make a “great headline,” veteran defense attorney Ron Kuby said at the time.<br>Murder in the first degree is typically charged in cases involving victims who are law enforcement members or possible witnesses to crimes. <br>Prosecutors allege an incriminating material recovered when the murder suspect was arrested include bullets with &#8216;deny&#8217;, &#8216;depose&#8217; and &#8216;delay&#8217; inscribed, described as a sign of his anger at the healthcare system which reportedly sprang from long-term back problems.<br>The Manhattan DA’s office had argued that Mangione should be considered a terrorist because he meant to kill Thompson to “intimidate or coerce a civilian population” — a claim that the judge rejected Tuesday.</p>

<p>Prosecutors said that after the murder, Mangione fled New York and was arrested days later at a McDonald&#8217;s in Altoona, Pennsylvania, 200 miles away. Police allegedly found a notebook in his backpack in which he wrote that killing Thompson was &#8216;targeted, precise, and doesn&#8217;t risk innocents&#8217;.<br>Police believe Mangione saw the execution as a &#8216;symbolic take down&#8217; and that he saw himself as a &#8216;hero&#8217;.<br>Mangione separately faces federal charges including murder through the use of a firearm, firearms offense and two counts of stalking.<br>The federal charges accuse Mangione of killing Thompson &#8216;in furtherance of an act of terrorism&#8217; and as a &#8216;crime of terrorism&#8217;.<br>By contrast Judge Carro on Tuesday wrote: &#8216;The defendant’s apparent objective, as stated in his writings, was not to threaten, intimidate, or coerce, but rather, to draw attention to what he perceived as the greed of the insurance industry.&#8217; </p>

<p>Some of the the suspect&#8217;s supporters seen outside court on Tuesday with pro-Mangione messages said they understand why he committed the crime.<br>&#8216;We&#8217;re here because we both support Luigi for what he did, taking a bite out of corruption of the healthcare industry,&#8217; one of his supporters said.<br>&#8216;He was the one that decided it was ok to take a bite out of corruption. Going the violent way is not always the best way but I support what he did. How many people can say they&#8217;d stand there and do that same thing?,&#8217; another pro-Mangione supporter said outside court.<br>Mangione&#8217;s supporters have raised more than $1.2million for his legal defense fund despite the seriousness of the allegations against him.<br>He is next scheduled to appear in court a year after the killing, on December 1.</p>
