<p class="mol-para-with-font">A man from California has been detained by immigration officials after he appeared in court to seek a restraining order against a relative who allegedly molested his 12-year-old daughter.<br />
&#8216;It&#8217;s hard to live without him. It&#8217;s frustrating,&#8217; asks the victim&#8217;s older sister who is wondering the culprit is still walking free.<br />
&#8216;What my uncle did to my sister — why is he not in jail? Why are we still looking at his face?<br />
Marcos Villanueva&#8217;s oldest daughter Keyli said the prospect of her father&#8217;s deportation from the U.S. has been devastating.<br />
Immigration and Customs Enforcement detained Villanueva on August 8, just two days after he testified in court to defend his 12-year-old daughter, <a class="class" href="https://ktla.com/2018/10/22/anaheim-father-facing-deportation-after-testifying-against-daughters-molester-family-says/" target="_blank" rel="nofollow noopener">according</a> to his attorney Willard Bakerman.<br />
The girl had accused her 51-year-old uncle of molesting her. A judge dismissed the case in July due to lack of evidence his family said, according to the <a class="class" href="https://www.ocregister.com/2018/10/20/anaheim-man-faces-deportation-suspects-man-suspected-of-molesting-his-daughter-tipped-ice/" target="_blank" rel="nofollow noopener">O.C. Register</a>.</p>

<div class="mobile-gallery-icon">Marcos Villanueva, a professional house painter, who&#8217;s being held at a facility near Irvine, California had no criminal record, according to his lawyer. Now, he&#8217;s scheduled to be deported at 5 a.m. on Tuesday to Honduras, where Bakeman said he would likely by kidnapped and killed.<br />
Villanueva in his deposition alleged that his 12-year-old daughter was being molested by a neighbor, related to the family. The family believes the relative tipped off ICE in retaliation and the 40-year-old father was detailed two days later.<br />
&#8216;I was left without a husband, from one minute to the next, and I didn&#8217;t even know who took him,&#8217; Villanueva&#8217;s wife, Jenie Villalvir, told KTLA.<br />
&#8216;I believed in justice in this country. My husband, he doesn&#8217;t owe anyone anything. He is not a criminal. He pays his taxes every year. He is a good father. He is a good person,&#8217; said Jenie.<br />
&#8216;The man who should be in jail is out while my husband is detained,&#8217; she added.<br />
He is currently being held at a facility near Irvine, could be deported despite having no criminal record.</div>

<div class="mobile-gallery-icon">The family says Villanueva fled to the U.S. from Honduras 13 years ago under fear for his life after witnessing a friend&#8217;s murder. Now he could be deported to Honduras, where he would likely be kidnapped and killed.<br />
&#8216;This is probably the most unjust and unfair case I&#8217;ve ever seen,&#8217; Bakeman told KTLA.<br />
He called Villanueva&#8217;s situation an example of ICE targeting victims rather than criminals.<br />
Furthermore Bakeman said, the restraining order Villanueva&#8217;s family had been seeking was not granted. The man accused of molesting Villanueva&#8217;s pre-teen daughter lives two doors away from their home.<br />

However, ICE say they had previously ordered Villanueva&#8217;s deportation in 2005 but he failed to go to court at the time because the notice didn&#8217;t indicate a time or location.</div>

&#8216;I know he&#8217;s not the only person that goes through this, but he deserves another chance,&#8217; his daughter Keyli said. &#8216;He deserves to be back with his family.&#8217;<br />
Villanueva first was detained in August 2005 in Texas. Immigration officials issued him a notice to appear in court. Villanueva failed to attend, and the government ordered him removed in absentia.<br />
He didn’t show up, Bakeman said, because the notice failed to include date, time or location.<br />
The order was “fatally defective,” making Villanueva’s deportation order not valid, Bakeman argued in court documents.<br />
In response to the allegations, ICE remains steadfast in its policies in that who violates immigration laws is subject to removal from the U.S.<br />
&#8216;While ICE continues to focus its enforcement resources on individuals who pose a threat to national security, public safety and border security, the agency does not exempt classes or categories of removable aliens from potential enforcement,&#8217; ICE said in a statement.</div>
