<div>A white police officer in Indianapolis has been fired after being caught on camera angrily confronting two black men outside a Nordstrom Rack and accusing them of being &#8216;suspicious&#8217;.<br />
Deputy constable Daryl Jones fired for alleged racial profiling incident caught on camera. The officer allegedly followed the two victims out of the store and then demanded a driver&#8217;s license.<br />
The incident occurred November 12th 2019 in Indianapolis Indiana, on the cities north side shopping district.</div>
<div>Officer Jones refused to provide a reason for pulling them over.</div>

Durell Cunningham said he and his cousin Aaron Blackwell were shopping inside the Nordstroms Rack store in in Indianapolis when they noticed the security guard watching them. He continued to watch them as they checked out, but never approached them inside the store.<br />
When they finished checking out and walked outside, Cunningham says the man followed them outside the store and watched them get into their vehicles.<br />
Blackwell started recording from the passenger seat after they noticed the man following them.<br />
Cunningham said he saw the security guard get into his vehicle and start to come toward them, so he pulled back around and in front of the store — that&#8217;s when the man jumped out of his vehicle and approached the two men.<br />
At this point Dep. Daryl Jones approached cousins as they drove out of the parking lot of the store in the north side of Indianapolis.<br />
The pair recorded the confrontation after an earlier encounter with Jones, who they said had racially profiled them and tried to run their car plates.<br />
Jones demanded the pair showed him identification and threatened to lock them up when they demanded to know why he had stopped them.<br />
He told the customers that they were being stopped &#8216;because you&#8217;re suspicious.&#8217;<br />
When they say he has no right to stop them, the officer yells: &#8216;I&#8217;ve got my rights to do anything that I want to do, I&#8217;m a police officer.&#8217;</div>

<div>One of the men accosted posted video footage of the incident online &#8216;Lawrence IN officer harassed me and my cousin after we spent over $1000 in the department store. He watched us buy everything, and then followed us to the car.&#8217;<br />
Segueing into the footage, the writer posts &#8216;This video picks up after we pulled off, and he screamed he was going run our plates once we pulled from the parking spot. So, we circled back to ask him why he was being invasive and abusing his authority!<br />
&#8216;From the video you will see is blatant disregard for being civil or calm, even though we were clear about our complaint without being angry, however we were stern because we believed we did nothing wrong or suspicious!</div>

<p> The officer never gave us his name or badge number. When he told us clearly in the video “I have the right to do anything I want to do, I’m a police officer!!”</p>

The officer refuses to give his name to the shoppers, and refuses their request for him to call a supervisor.<br />
He then reveals that he is working off-duty &#8211; suggesting he is working as a security guard at Nordstroms.<br />
Jones repeatedly demands they hand over identification, and insists he will let the pair go if the drivers licences check out, and they have &#8216;no outstanding warrants&#8217;.<br />
But he loses his temper again when Cunningham replies, &#8216;Oh, it&#8217;s not going to let go.&#8217;<br />
He shouts: &#8216;Don&#8217;t threaten me. Are you threatening me? Are you crazy, you&#8217;re going to threaten a police officer?&#8217;<br />
Cunningham: &#8216;I&#8217;m not scared of you, we ain&#8217;t broke no laws.&#8217; as Jones peers into the driver side window.<br />
</span><span style="color: var(--color-text);">Jones eventually calls for back-up, and an officer from the Indianapolis Metropolitan Police Department arrives on the scene.</span></div>

</span><span style="color: var(--color-text);">The IMPD cop pulls Jones to one side and asks if the men had shoplifted.<br />
</span><span style="color: var(--color-text);">&#8216;No, they didn&#8217;t steal items,&#8217; the man can be heard telling the officer.<br />
</span><span style="color: var(--color-text);">&#8216;They bought a bunch of stuff, but when they were sitting right here I was trying to get their license plate and he hollers out the window, &#8220;You&#8217;re not getting my plate,&#8221; and he takes off.&#8217;<br />
</span><span style="color: var(--color-text);">The men then explain the situation to the IMPD officer as Jones returns to his car, and the new cop says that he does not believe there was a traffic infraction.<br />
</span><span style="color: var(--color-text);">He also confirms that the men were not required to hand over their IDs, as Jones did not appear to have reasonable suspicion that a crime had taken place.<br />
</span><span style="color: var(--color-text);">The cop says on the video: &#8216;Based on what happened I don&#8217;t think either of us have reasonable suspicion to believe there&#8217;s a crime taken place, so there&#8217;s no reason for a traffic stop.<br />
</span><span style="color: var(--color-text);">&#8216;So there&#8217;s no legal requirement for you to identify yourself to an officer at that point, and if you don&#8217;t want to give him ID you don&#8217;t have to give him ID.&#8217;</span></p>

</span><span style="color: var(--color-text);">&#8216;I just feel violated from my rights and how he went about the situation, it wasn&#8217;t professional,&#8217; Cunningham told </span><a class="class" href="https://www.theindychannel.com/news/local-news/lawrence-twp-deputy-constable-fired-after-video-of-alleged-racial-profiling-situation" target="_blank" rel="nofollow noopener noreferrer">WRTV.</a><br />
<span style="color: var(--color-text);">Lawrence Township Chief Constable Terry Burns fired Jones shortly after viewing the video of the encounter.<br />
</span><span style="color: var(--color-text);">Burns told </span><a class="class" href="https://www.theindychannel.com/news/local-news/lawrence-twp-deputy-constable-fired-after-video-of-alleged-racial-profiling-situation" target="_blank" rel="nofollow noopener noreferrer">RTV6</a><span style="color: var(--color-text);">: &#8216;He was terminated last night when the video was brought to my attention. I did see the video and made the decision immediately and that pretty speaks of my reaction.&#8217;<br />
</span><span style="color: var(--color-text);">Burns, an officer for about 20 years, had reportedly also been working for security for Nordstrom. The store </span><span style="color: var(--color-text);"><span style="color: var(--color-text);">reportedly told Blackwell they had also let the officer go from his security duties.</span></span></div>
<div>A spokesperson for the Indianapolis Metropolitan Police Department says no report was ever filed from the incident, although an officer did respond to the scene Tuesday afternoon.<br />
Lawrence Township Constable Terry Burns said the man was terminated from his position as a deputy constable Wednesday evening after Burns learned about the video.<br />
“He was terminated last night when the video was brought to my attention. I did see the video and made the decision immediately and that pretty speaks of my reaction,&#8221; Burns said.<br />
Burns said the deputy constable had been working security for Nordstrom Rack earlier this week, but he was unsure if he was on that job Tuesday afternoon.<br />
Blackwell said Nordstrom contacted him after he posted the video on YouTube and reached out to their loss prevention supervisor. He says they informed him they had also let the security guard in the video go.</div>
