<p class="wp-block-paragraph">The ex-convict whose savage beating of a woman from Queens, at a New York subway station, caught on surveillance cameras, that shook New York City last year has been indicted on murder charges in the death of his Bronx girlfriend, Jessica Miller.<br>Waheed Foster, [photo, left], a 42-year-old homeless man pled not guilty when he appeared before a judge at the Bronx Supreme Court earlier this month on allegations that he strangled his former partner Jessica Miller on Aug. 6, 2022. <br>Foster who who had a prior conviction for murder of a family member as a juvenile has long history of viciously attacking people. He was already on parole for a 2010 assault.<br>Miller, 40, was found unconscious in an apartment about a block from her home in Morris Park by NYPD officers responding to a 911 call. <br>Her death was later ruled a homicide, with the city Medical Examiner’s Office determining that she was strangled.<br>Foster, who has been in custody up since his September arrest in the chilling transit attack on transit passenger, was indicted in December on murder and manslaughter charges in the death of Miller. However, he only appeared in court April 10 when the indictment was unsealed.<br>The violent career criminal also faces attempted murder and assault charges in the unprovoked beating of Elizabeth Gomes, 33, at the Howard Beach subway station on Sept. 20.</p>

<p class="wp-block-paragraph">Gomes was beaten so brutally by the unhinged career criminal that she feared she would lose sight in her right eye.<br>“We’re going through a lot here,” the victim said after the attack that was caught by surveillance cameras.<br>“I remember hearing that they would have cops posted on platforms, riding on trains, cops down in a subway … There was no one.”</p>

<p class="wp-block-paragraph">Gomes, a married mother-of-five was on her way to her job at JFK International Airport shortly after 5 a.m. last September, when Foster allegedly pounced on her, throwing her into the wall, and punching and kicking her into unconsciousness.<br>Foster who was indicted in that case on Sept. 30 and brought into court on a warrant the following month, is undergoing a psychiatric evaluation.</p>

<p class="wp-block-paragraph">Foster’s criminal record dates back to his youth in the mid-1990s, when he was charged with beating his 82-year-old foster grandmother to death, aged 14.<br>The victim, Ariela Mascha, suffered 20 broken ribs, a stab wound to her leg and a punctured liver during the fatal attack, which sources said ignited by a dispute over money, in 1995.<br>Foster was living with his grandmother at the time and confessed days after the fatal encounter to killing her, when he was confronted by detectives about inconsistencies in his story.<br>He was convicted as a juvenile but it is unclear how long he was institutionalized.</p>

<p class="wp-block-paragraph">Following the attack on his wife, the Gomes&#8217; husband, Clement Tucker, queried the wisdom of releasing the dangerous thug to run the streets. <br>Tucker, 41, said incredulously, “This guy kill his grandmother at 14 years old.<br>“He injured so many people. Why is he on the street? That’s what we trying to find out,&#8217; Tucker asked. <br>“It’s crazy. She’s going to lose her sight if she doesn’t get some help real soon,” Tucker added.<br>“Her pupil was outside her eye. Her eye!</p>

<p class="wp-block-paragraph">Foster was on parole in a separate case at the time of the merciless attack on Gomez.<br>In 2010, he stabbed a woman in the face at a mental institution. He has also been arrested for assaulting a woman with a screwdriver, criminal mischief, robbery and larceny, law-enforcement sources said.<br>He was released from prison in 2021 after a 12-year sentence on the assault charge in Queens and was on parole through November 1, 2024.<br>While under post-release supervision, Foster was arrested twice for misdemeanors on Aug. 21 and then again for a parole violation on Sept. 8, only to be released without bail, leaving him free to menace the public and allegedly attack Gomes in September. <br>Foster is due back in Queens court on May 1 in the case of assaulting Gomes.<br>His next court date in the murder of Miller is scheduled for June 14.</p>
