Alexis Von Yates pled no contest to a charge of lewd and lascivious battery at a court in Ocala, Florida on Thursday

The 34-year-old Florida nurse was caught raping her stepson, 15, last summer when her husband walked on them

Yates told her husband she asked the boy to stop, while the teen said she instigated the encounter, with graphic details of the sex after they vaped cannabis oil, played video games and watched a movie

As per her plea deal Von Yates will receive a lighter sentence of two years in prison, followed by two years of community control and ten years of sex offender probation

She will also complete 200 hours of community service, cover court costs and pay fines 

Accepting the plea, the judge noted that the penalty is a ‘significant downward departure’ from typical sentencing guidelines’

A Florida nurse whose husband walked in on her rape of her teenage stepson will be handed a significantly reduced penalty at sentencing after signing a plea arrengement on a reduced charge. 
Alexis Von Yates was arrested last summer and charged with sexual battery of an unnamed teen, who at age 15 was three years under Florida’s age of consent.
Von Yates, 34, pled no contest to a charge of lewd and lascivious battery inside an Ocala courtroom Thursday, instead of the original charge of sexual battery on a person between the ages of 12 to 18 years of age. 
The plea deal will see her spend two years in prison, followed by two years of community control and ten years of sex offender probation. 
She will be further mandated to complete 200 hours of community service, cover court costs and pay fines.

While accepting the plea, the judge noted that the penalty as stated in the deal is a ‘significant downward departure’ from typical sentencing guidelines.
Prosecutors reportedly, have said the victim’s family supports the agreement as it forestalls the 15-year-old boy having to return to Florida to testify at trial, as this would disrupt his ongoing mental health treatment.
The incident happened in July 2024. Von Yates was arrested and charged in November. 
Court documents at the time of her arrest revealed that her husband Frank, a linesman, had walked in on Von Yates sexually assaulting his son.
The teen who did not live with Frank and his current wife, was only in the home because he was staying with his father for the summer.

The teenager spoke with investigators last August, saying he had been in Florida on vacation to visit his father over the summer. 
The teen described in graphic detail how he had sex with Von Yates after they spent time vaping cannabis oil and playing video games before watching a movie together. 
Von Yates started telling the teenager ‘how horny’ she was after not having sex for two weeks because she had been on her period. 
He told investigators Von Yates had made jokes about her sexual appetite the whole week before they had sex.
He described in detail how he started kissing her neck, with Yates saying: ‘I wish you were 18, because you’re not old enough.’

Von Yates, a former health care professional, was arrested and charged last year following the incident last July. She pled not guilty in December

Von Yates he said, then kicked off her underwear before engaging in oral sex and intercourse without the use of a condom.
According to the affidavit, Von Yates would occasionally say ‘oh f***’ and ‘this is so bad’ during the tryst. 
The document also describes how they ‘heard something in the garage’ but ‘kept going’ before the boy’s father walked in after returning from working a late shift. 
When his father walked in, the teenager told investigators he ran to the bathroom with his pants around his ankles. 
The boy said when questioned by his father he refused to tell him what had happened.Von Yates on the other hand told her husband she had asked the boy to stop. 

The teenager’s told his police interviewers that Von Yates told him ‘how horny’ she was after not having sex for two weeks because she had been on her period 

The boy according to the affidavit, insisted that her version was not true and feared his father was going to beat him with a belt.
Von Yates is also said to have told her husband that she had sex with his teenage biological son because he looked like his dad when he was younger, the boy claimed. 
Von Yates also said her stepson’s penis looked like a more youthful version of her husband’s, the victim claimed.  
Following the assault, the boy was taken to his grandparents’ house, with his father telling him on the way that he had ‘ruined his life’.
According to the teenager, his father stopped on the way for a six-pack of beer and was drink driving.
Once at his grandparents’ home, the boy said his grandfather discouraged him from calling his biological mother to tell her what had happened.
The following day the teen called Von Yates who told him he wished his father hadn’t caught them, the affidavit adds.

In October, the victim’s father eventually sent an anonymous tip to police about the incident, the affidavit says.
According to the arrest report, several of the teens’ relatives tried to discourage him from disclosing to police what had happened.
The documents also state an unknown person named ‘Kaylee’ reached out to the teen, with the message that his father was willing to protect him ‘if he testifies’. The teenager was informed his father didn’t want to live with his step-mother any longer.
Alexis Von Yates was arrested in November on a charge of sexual battery of a minor. Florida immediately suspended her license to practice as a nurse in the state.
She is scheduled for sentencing on September 16, when the victim and his biological mother are expected to deliver their victim impact statements to the court.
