<p class="wp-block-paragraph">A 4-year-old girl is dead after she was shot by her mother after a custody hearing on Tuesday, according to the Houston Police Department.<br>Houston Police Department officers on arrival found the child dead from gunshot injury. Investigators say the girl’s mother was also found with a gunshot wound and was taken to a hospital in critical condition. <br>The shooting happened at 5:45 p.m. at 300 Terra Reserve in west Houston on night of Tuesday, September 30.<br>The deceased girl was identified as Vivian Savella by the family&#8217;s attorney.<br>Investigators allege the mother, 35-year-old Cibella Savella, shot her daughter to death, then turned the gun on herself but survived.<br>The child&#8217;s stepfather and childcare aide were at home at the time of the shooting.<br>The estranged parents, Cibella Savella and Aaron Savella, were embroiled in a contentious custody battle over their daughter. <br>Sources close to the family revealed that a family court judge had just granted custody of Vivian to her father, and she was supposed to be turned over to him Tuesday night. According to court documents, the father was awarded primary custody and the mother was, &#8220;awarded possession of the child only when continuously supervised.&#8221;</p>

<p class="wp-block-paragraph">A child custody case was pending between Savella and the mother at the time of the shooting, according to statements from police and Savella&#8217;s attorneys, along with court records.<br>A temporary order issued by a judge on Tuesday, granted Savella the temporary, exclusive right to determine his daughter&#8217;s primary residence and make decisions about her medical care and education. The mother was allowed to see her daughter only during supervised visits, according to the temporary order.<br>According to a statement from his lawyer, Aaron Savella trusted the courts, followed every order, and waited for the process to work.<br>According to that court ruling, a supervisor should have been with Vivian and her mother on Tuesday but no supervisor was present, which according to the family&#8217;s attorney was because the decision on Vivian&#8217;s custody had just been made. The agency responsible for supervision were yet to be notified on the case.</p>
