Ohio teacher, Madeline Marx, plans insanity plea after admitting she had sex with two 11-graders in local parking lots
An Ohio substitute teacher who was arrested on school grounds last month, over student-sex allegations plans to plead not guilty to sexual battery by reason of insanity.
Lawyers for Madeline Marx, 23, gave notice of the novel defense when she appeared in court Wednesday following claims of sexual misconduct while employed as a teacher at Kettering Fairmont High School, the Dayton Daily News reported.
The Kettering Fairmont High School substitute teacher who is accused of having sexual contact with two students plans to submit motions to determine her competency and fitness to enter a plea of not guilty by reason of insanity.
Before proceedings Marx was observed dabbing her eyes as she was comforted by a woman who came with her. She had tissues with her while at the podium and continued sobbing through the hearing,

The freshman teacher was arrested in November 8 for allegedly having sex off-campus with two 11th-grade students after a 17-year-old student told police he was given oral sex by a teacher July 19 in the parking lot of Big Lots on Wilmington Pike, according to a complaint, affidavit and statement of facts filed in court. Another 16-year-old male student told police he had intercourse with a substitute teacher Sept. 21 in the parking lot of an apartment complex on Smithville Road. Both teen interviewed by Kettering police confirmed the illicit encounters occurred in local parking lots.
Marx’s attorney said she intend’s to enter an insanity plea
Marx allegedly, agreed the improper liaisons occurred and admitted to police that she also sent several nude photos to one of the teens through Snapchat and Instagram.
Marx’s lawyer, Keith Fricker, announced Wednesday that he plans to submit motions to determine her competency and fitness.
If convicted, she could face up to three years in prison,
