<div>A 15-year-old girl who shot and killed her mother&#8217;s out of control boyfriend in an attempt to save her mother from being strangled to death, will not be charged, police in North Carolina have said.</div>

<p class="mol-para-with-font">Steven Kelley, 46, was found dead from two gunshot wounds just after midnight on August 8 in a Forest City home he shared with his girlfriend Chandra Nierman, 44, and her three children.<br />
Prior to this being shot, Kelley had threatened and endangered the lives of all the members of the household the Rutherford County Sheriff&#8217;s Office determined.</p>

<div>Investigators from the Sheriff&#8217;s Office say Steve kelley, prior to the shooting, had threatened to slit Nierman’s throat and kill everyone in the house.<br />
As he terrorized the entire household and began choking Nierman, her twelve-year-old son retrieved a firearm, then his fifteen-year-old sister took the gun from her brother and fired twice, striking Kelley in the chest.<br />
Kelley, a convicted felon who had two active domestic violence protection orders against him from two different women, had threatened Nierman several times previously, including firing multiple rounds from a firearm inside the house just days earlier, an investigation revealed.</div>

<p class="mol-para-with-font">The children&#8217;s mother suffered significant bruises and contusions from the assault in the home, about 65 miles west of Charlotte, North Carolina.<br />
Her other daughter, 16, was grazed in the leg by a fragmented bullet from one of the fired rounds and taken to Spartanburg Regional Hospital where she was released the following day.</p>

<p class="mol-para-with-font">Multiple guns were found by police in the house and on Kelley&#8217;s body that belonged to him.<br />
On Friday, Lt. Jamie Keever presented the case to the District Attorney&#8217;s Office where it was found the shooting was justified and no charges will be filed against the children.<br />
All five had recently moved to the area from Indiana.<br />
The children have not been named because they are minors.<br />
Nierman, her children and Kelley had recently <a href="https://www.mcdowellnews.com/news/rutherford-teen-shoots-kills-mom-s-boyfriend-during-assault/article_5320daec-9cde-11e8-973b-0f3dc2ee69a9.html" target="_blank" rel="noopener">moved to the area from Indiana, reported McDowell News.</a><br />
A press release after highlighted that Kelley kept “multiple” guns in the home and had threatened Nierman in the past. Five days before the shooting, Kelley had “assaulted Nierman and fired multiple rounds from a firearm inside the residence to threaten and terrorize Nierman,” the release said.<br />
No domestic violence calls had been made from the family’s home in the past, but two women (one in Ohio and one in Indiana) have existing “domestic violence protection orders” against Kelley, the sheriff’s office statement said.</p>
