Jane Doe’s lawsuit
The complaint, originally filed in state court and later transferred to federal court, said that Jane Doe did not go to the police immediately after the alleged assault because she didn’t want her family to know and was afraid of retribution from the menJane Doe a 30-year-old woman claiming to be the ex-girlfriend of accused Knicks new boy, Derrick Rose, then with Chicago Bulls of drugging and gang raping her along with two of his friends. The lawsuit named Rose, along with personal manager Randall Hampton and pal Ryan Allen, as her attackers.
The sexual assault allegedly took place in August 2013, according to the plaintiff, who accuses Rose and his friends of slipping drugs into her drink at his Beverly Hills house. Although she managed to return home with the help of a friend, the alleged victim claims Rose and his crew broke into her apartment later that night and gang raped her while she was incapacitated.
She claimed only coming forward with the accusations now because she was “ashamed and embarrassed” at the time of the alleged rape, according to the suit.
The woman, who claims to have dated Rose between 2011 and 2013, also accuses the NBA superstar of trying to sleep with her friends while pressuring her to take part in group sex throughout the course of their relationship.

Rose’s lawyer, Lisa Cohen, called lawsuit is “outrageous.” and “will be dismissed.” “an attempt to shake down a highly respected and succcessful athlete,” and said she and Rose had a “non-exclusive, consensual sexual relationship for over two years.”
“We have complete confidence that the case will be dismissed and that Mr. Rose will be vindicated. This lawsuit is outrageous,” Cohen said.

Rose maintains what happened was consensual – and doubled down on his stance in court papers filed Monday.
“This is not a rape case. It’s pure and simple extortion by a plaintiff who wants to hide behind the cloak of anonymity while seeking millions in damages from a celebrity with whom she was in a long-term nonexclusive consensual sexual relationship,” the new filing says.
U.S. District Judge Michael W. Fitzgerald later denied Rose’s motion to dismiss, concludings that the athlete had failed to prove that the woman had consented to sex with Rose and two friends in August 2013.

However, the basketballer’s lawyer argue that the “Plaintiff is a 30-year old adult who was in a consensual relationship with Mr. Rose; she was the sexual aggressor that night; she brought another woman with her, she claimed she bought (and did bring) the sex toys, she drank before arriving, and asked Mr. Rose for drugs (which he declined) and alcohol.”
The 27-year-old former Bulls’ lawyers says his defense is bolstered by Doe’s own text messages.
“(Her) own text messages which were wrongfully withheld until the day after her deposition, contradict the allegations in the complaint. The texts show (Doe) being adventurous, claiming to buy and bringing a sex belt to have fun with Mr. Rose, and then asking Mr. Rose to drive over to her house at 1 a.m. for more consensual sexual interaction”.

“Plaintiff also withheld texts showing that when she woke up the next morning, she asked Mr. Rose for reimbursement for her cab fare and the sex toys she claimed to purchase, and mentioned only that she had a hangover and had to get to work,” the filing says.
Rose is trying to use the texts to argue she should not be allowed to be identified as “Jane Doe” during the trial.

The plaintiff’s Lawyers described the Rose filings as “misogynistic.”
“They have no response on the merits, so they call the victim a sexual aggressor when she’s a rape victim,” said one of the attorneys, Brandon Anand.
The case is scheduled to go to trial Oct. 4, the same day the NBA’s preseason begins.
