“At 9.30pm, the witness was in her flat at the locus and overheard her neighbour, Miss Blacklaw, talking with a male in the common close

Blacklaw is said to have ‘no recollection’ of the incident due to alcohol

Blacklaw claims to have ‘no recollection’ of the incident due to alcohol
“He contacted the police and by the time officers arrived both the accused were fully dressed.
“They were detained and made no reply to caution and charge.”
Kenneth Greener, defending Blacklaw, said: “She is a first offender in every sense of the word and she can’t begin to describe her embarrassment at this.
“She went to the pub at 8.30pm and by 10pm this incident was being reported to police.
“Alcohol took hold very quickly and she has absolutely no recollection of this incident. There is no sense to it given it was right outside her own house.
“She had an overnight spell in custody and also lost her tenancy as a result of this. It is not an offence that is going to be repeated.”
Jackson Bateman, defending Kirkland, said: “He is thoroughly embarrassed by this entire incident.
“He fully acknowledges his behaviour is completely unacceptable.
“He is a chef to trade and he has just completed a stint working at a caravan park.”
Sentencing the pair, Sheriff Ray Small told them: “I don’t think there is anything that I can do that will add to your own embarrassment at this incident being raised in public.”
