Philip Moreno, 45, of Port Richmond, Staten Island was charged on Tuesday with murder, criminal possession of a weapon, criminal possession of a firearm, criminal use of a firearm, assault, reckless endangerment, and acting in a manner injurious to a child.
Moreno was seen leaving the home on Grandview Avenue just after 5pm – Cops found on his possession a .22-caliber semi-automatic Ruger handgun and a silencer
The home belonged to Alafia Rodridguez, 46, and his girlfriend, Ana DeSousa, 33. The couple’stoddler was found in the home unharmedÂ
An unidentified 43-year-old woman was also shot during the home invasion was rushed to hospital and was listed in critical condition after surgeryÂ
The couple who had been dating for three years and shared a two year-old daughter were expecting their second child
Police say illegal narcotics and drug paraphernalia were found inside the victims’ residence, raising possibility home invasion was drug-related Â
Moreno was convicted for manslaughter at 17, served 14 years in New York state prison for 1992 manslaughterÂ
The New York Police Department arrested Philip Moreno, an ex-convict from Port Richmond, Staten Island was arrested in connection with the fatal shooting of Alafia Rodriguez, 46, and his girlfriend, Ana DeSousa, 33 inside their home on Monday
Moreno, 43, was taken into custody by police just after 5pm, according to The Staten Island Advance.
While NY authorities are trying to determine if the home invasion was drug-related, Moreno was officially charged on May 12 with murder, criminal possession of a weapon, criminal possession of a firearm, criminal use of a firearm, assault, reckless endangerment, and acting in a manner injurious to a child.

A two-year-old girl believed to be the couple’s daughter, Blue, was found uninjured inside the home.
An unidentified 43-year-old woman was shot in the back in the home was rushed to Richmond University Medical Center in the West Brighton section of Staten Island, according to police.
She was listed in critical condition after undergoing emergency surgery on Monday night, but she is expected to survive.Â
Gallucci reportedly, last spoke to Rodriguez on the phone on Saturday about their future plans to meet up for a summer barbecue, said Rodriguez was looking forward to becoming a father again.
