A Florida mayor has accused her estranged former sheriff’s deputy husband of raping her three times while she was unconscious during their marriage.
Milissa Holland, 46, claims David O’Brien raped her three times in 2013 while she was taking Tramadol to treat a knee injury.
She said she went to sleep fully clothed after mixing the painkillers with wine but woke up undressed and ‘feeling strange’ with vague memories that her husband had assaulted her.
The pair separated at the time but she declined to press charges and did not file for divorce because she was still reliant on her husband’s healthcare insurance to pay for her sick daughter’s medical bills.
She was unemployed until being elected the Mayor of Palm Coast in November 2016.
In April this year, after the four-year statute of limitations which would allow him to be prosecuted or sued for the rape, O’Brien, 53, filed for divorce.
He is demanding a 2007 SAAB as part of their divorce and asks that his wife pay his legal fees.
Holland is seeking $5,000-a-month from him in alimony.

The couple married in 2012. He had worked for Flagler County Sheriff’s Office for more than two decades and had risen to the rank of undersheriff when they tied the knot.

O’Brien, 53, has three grown daughters Chelsea and Kristen are grown, Brianna. Holland, 46, has two sons, grown sons and her daughter Tory will soon be 24.
David O’Brien had worked for Flagler County Sheriff’s Office for more than two decades and had risen to the rank of undersheriff when they tied the knot.
In February 2013, Holland, a former county commissioner, was prescribed 50 mg Tramadol pills to treat a knee injury. She was told to take the pills for four days.
On the first day of the course of treatment, she drank wine with her husband while they had dinner and drank some more afterwards.
She claims to have gone to bed fully clothed but said she woke up naked and ‘feeling strange’. The same thing happened for the next three nights.
After the treatment, she confronted her husband and he allegedly admitted ‘taking advantage’ of her while she was unconscious.
Holland later said she believed the assault went on ‘for hours’ and that she vaguely remembered being dragged by her husband to the end of the bed so that he could perform oral sex on her.

A month after the assault, he contacted Jeff Stuart, a friend at the Flagler County Sheriff’s Office, and asked to meet him in the parking lot of a bank at 2am where he confessed that his wife was planning to accuse him of rape.
Stuart allegedly went to Holland’s home to speak with her afterwards. The Sheriff’s office later contacted prosecutors who asked Holland if she wished to press charges but she declined.
In 2015, prosecutors asked her if she wished to restart the investigation after being shown an email in which O’Brien allegedly admitted to raping his wife.
It read: ‘I take full responsibility for all my actions and for raping (redacted) and causing her so much emotional and physical pain and abuse,’ according to The Dayton News Journal.  

Holland stayed married to the man in order to use his health insurance to pay her adult daughter Tori's medical bills,. They asked her to call her husband and record the conversation, during which she asked: ‘How do you live with yourself knowing that you raped your wife?’

He replied: ‘I don’t, I don’t, I don’t live with myself. OK. I don’t at all.’
The declined again, saying that she still relied on his health insurance to pay for her adult daughter’s healthcare. She has a chronic auto-immune condition which her mother’s insurance did not cover at the time.
In April this year, O’Brien filed for divorce. His estranged wife’s lawyers say his timing is down to the four-year statute of limitations which was in place at the time of the alleged assault.
Florida has since extended the statute of limitations for reporting rape cases to six years but any incidents which occurred before the change in law are still bound to the old limit.
O’Brien resigned from the police force in March 2013 to avoid being fired after being given a bad review.

Things Fall Apart
In 2012, Holland and O’Brien looked like the perfect couple on their way to the best of years of their life.  In January, they announced an April wedding date. In February, O’Brien, by then a 29-year veteran of the Flagler County Sheriff’s Office, was named chief deputy, the Number 2 position in the administration of-Sheriff Don Fleming.
In May, shortly after the couple returned from a honeymoon in Paris, Holland, who had been a charismatic county commissioner for six years, declared her run for the state House. Her confidence was boundless. O’Brien’s future at the Sheriff’s Office looked equally bright.
Less than a year later, things started looking bleak for the couple.
Holland lost her House race and was jobless until she was elected mayor of Palm Coast last November. A new sheriff passed over O’Brien for undersheriff, appointing Rick Staly instead.
Weeks later, after a withering, eight-page performance review by Staly (who is now sheriff), O’Brien was given a choice: resign or be fired. O’Brien resigned. He did so on March 8, 2013.
Five days later, Holland formally accused O’Brien, her husband of less than a year, of raping her repeatedly over several nights while she was unconscious, knocked out each night from a mixture of pain killers and alcohol.

The alleged rapes took place roughly between Feb. 7 and Feb. 11 of 2013. Ironically,  a month before he lost his job,on Feb. 5, David O’Brien had been tasked by the Sheriff’s Office with chairing a committee on domestic violence.
Holland would subsequently tell investigators that she began piecing together the events of those nights through “flashbacks” before she confronted O’Brien.
“It was around day three when I started remembering things,” Holland would later say.
“very like, clear, vivid things that came in my memory, and that’s when I started putting things together and confronted him outside by our pool, and asked him very directly. It’s not something you expect your husband to ever do. It would have been the last.
O’Brien, on his part, has never publicly commented on the rape allegations.
