A former Colorado police officer who did not stop another officer from being rough with a 73-year-old woman with dementia was sentenced Friday to 45 days in jail and three years of probation.
Former Loveland police department employee Daria Jalali earlier pled guilty after the violent arrest of Karen Garner in Loveland, about 50 miles north of Denver, in June 2020. She war was placed on leave in 2021. 
Another former officer Austin Hopp arrested Garner after she left a store without paying for about $14 worth of items – including a candy bar, a can of Pepsi and a t-shirt. 
The callous officers were seen celebrating after leaving the disheveled fragile woman locked in a jail cell, howling from the pain of the officers snapping her arm when they put on the handcuffs.

Police body camera video of the arrest incident, released a year later, shows Garner repeatedly saying that she was trying to go home.
After Garner turned away from him, footage showed Hopp grabbing her arm and pushing her to the ground and cuffing her. 
Later, he pushed her against the hood of his car and, after she tried to turn around, he moved her snapped left up arm up near her head. 
Soon after, Garner began to slump toward the ground. Jalali, who arrived after Garner was handcuffed, is heard saying, ‘Stand up! We’re not going to hold you

Police station surveillance video from 2020, which was released by Garner’s lawyer from Hopp’s trial, shows the ex-cop, Jalali and a third officer, Tyler Blackett, talking, fist-bumping and at times laughing or joking about the arrest as they watch the body camera footage with Garner in a holding cell nearby.
The two former cops were also in a romantic relationship at the time of the scandal and had moved in together while Hopp was still married to his wife of six years. He went on to obtain a divorce in June 2020.
Several of Jalali’s neighbors confirmed that Hopp and Jalali were reserved and weren’t very friendly.

A video from Loveland Police Department body camera footage shows Karen Garner on the ground while being arrested on June 26, 2020. Later the arresting officers Hopp and Jalali are caught sharing what appeared to be a fist bump after placing Garner, who was screaming in pain, in a jail cell.
In the aftermath as Hopp was hauled off to jail, Jalali faced up to 60 days in jail for failing to intervene, a crime created by lawmakers as part of a police reform bill passed during protests over racial injustice and police brutality in 2020. 
Hopp went on trial for his cruel actions. In May of 2022, he was sentenced to five years in prison for his treatment of Garner. He had faced a mandatory prison sentence of between 10 and 32 years under an original, more serious assault charge.
The city of Loveland settled a $3million lawsuit filed by Garner for a dislocated shoulder, a broken humerus and a sprained wrist. Her family has said her condition deteriorated after her arrest and she requires around-the-clock care as a result.

Jalali faced up to 60 days in jail for failing to intervene, a crime created by lawmakers as part of a police reform bill passed during protests over racial injustice and police brutality in 2020. 
Hopp was sentenced in May to five years in prison for his treatment of Garner. He had faced a mandatory prison sentence of between 10 and 32 years under an original, more serious assault charge.

Jalali apologized to Garner and her family in court, the Loveland Reporter-Herald reported. She told Judge Joshua Lehman that she thought Garner was intoxicated and believed Garner was only complaining about her handcuffs so she could get out of them.
‘I wanted to be a good police officer and my heart was in the right place, but I still came up short,’ she said.

Jalali’s lawyer, Anna Geigle, said Loveland police and another department let her stay on the job despite a pattern of poor performance recorded in her personnel files. A neuropsychological evaluation showed Jalali did not have the ‘psychological makeup’ to act with the precision and awareness expected of police officers, she said.
Lehman said Jalali should have known Garner was a ‘delicate’ woman suffering from a mental health issue: ‘She just sounds out of it and terrified to me,’ he said after watching body camera footage from the arrest for the first time in court, adding, ‘The fact that two law enforcement officers couldn´t comprehend that is incomprehensible to me.’
Garner’s son, John Steward, told the judge Jalali had no idea of the stress, pain and sadness the arrest has caused his family.
‘We all have choices to make in life, and all our choices have consequences,’ he said. ‘I ask that justice be served for my mom today.’
