‘Fired is not enough for my family,’ Zoraida Garcia told The Inquirer. ‘He needs to be in jail.’

27-year-old Eddie Irizarry was shot dead through his car window in North Philadelphia on August 14 by Dial, just five seconds after he got out of his patrol vehicle, newly released footage shows.
Police originally claimed Irizarry was ‘driving erratically’ before getting out of his car with a knife and lunging at officers.

Surveillance video provided by a local resident to the victim’s family shows Eddie Irizarry pulling into a parking spot, running over orange traffic cones, and stopping before a police vehicle pulled up to the passenger side of his car a few seconds later on a narrow residential street.
A police officer is seen in the footage getting out of the passenger side of the police cruiser and pulling out a firearm from his belt as he was walking across the cruiser toward Irizarry’s car.
The officer appears to yell, “Show us your hands! followed by “Show me your hands” twice.
Five seconds later, the officer appeared to fire his gun six times, with at least one shot striking Irizarry’s front windshield.
While firing his weapon, the officer is heard shouting what sounds like, “Drop the knife!”

Still from surveillance footage apparently contradicts the narrative that police on how and why officer Eddy Dial shot Eddie Irizarry dead within five seconds or pulling him over for ‘driving erratically’
The footage, taken by a nearby home surveillance camera, was released by Shaka Johnson the attorney representing Irizarry’s family’s bid to counter that narrative.
Johnson explained that he and the victim’s family returned to the block on which the shooting happened in search of footage themselves.
Johnson describes the narrative spun by the police as ‘an intentional misleading of the public.’

In surveillance video, taken almost opposite the scene, Dial is heard yelling ‘I will f***ing shoot you,’ at Irizarry before opening fire at near point blank range through the driver’s side window
In the surveillance video, taken almost opposite the scene, Dial is heard yelling ‘I will f***ing shoot you,’ at Irizarry before opening fire at near point blank range through the driver’s side window.
He is then seen firing again through the windshield as he ran backward and circled around the car.
‘Shots fired, shots fired,’ one of the officers said over police radio.
Irizarry was shot six times and could be seen in the video writhing in pain.
The officers pulled Irizarry’s body from the driver’s seat and carried him, by his arms and one of his legs, to their police van.
He was rushed to Temple University Hospital but died a short time later.
‘What about what you just saw could ever be confused as, “He got out of the car and lunged at police officers”?
‘That was an out-and-out, flat-out lie’ Johnson added.

Johnson said he intends to file a wrongful death lawsuit against Dial and the City of Philadelphia on behalf of the family.
‘In my view,’ Johnson said, ‘this is a crime against humanity, to be perfectly truthful.’
Johnson said the City Solicitor’s Office had invited Irizarry’s family to privately watch the body-worn camera footage last Friday but the Philadelphia District Attorney’s Office rescinded that offer, citing an ongoing investigation.
He announced that he would be turning over the surveillance footage to all law enforcement agencies investigating the fatal shooting.
City of Philadelphia Citizens Police Oversight Commission [CPOC], released a statement Tuesday that it has been actively monitoring the investigation currently being conducted by the Philadelphia Police Department.
‘Based on information we have reviewed, we have recommended that PPD terminate Officer Dial,’ the CPOC said.

Police Commissioner Danielle Outlaw said Dial would be suspended for 30 days, with the intent to terminate his employment for insubordination
Police have since changed their narrative, admitting that Irizarri was shot inside his car and not outside as they previously claimed.
Philadelphia Police Commissioner, Danielle Outlaw, addressing the media said Dial would be suspended for 30 days, with the intent to terminate his employment, citing administrative violations of insubordination, refusal to promptly obey proper orders from a superior officer and a conduct unbecoming violation for “failure to cooperate in any departmental investigation.” Outlaw said the investigation into the shooting itself continues.
Commissioner Outlaw said that a review of the officers’ body-worn cameras “made it very clear that what we initially reported was not actually what happened.”
Police she said, are trying to determine the source of the initial erroneous version, which an official earlier said was called into police radio and appeared to have come from “an internal source.” Outlaw said that probe may result in disciplinary action if warranted.
Fortunato Perri, a lawyer who represents the Fraternal Order of Police, said in an statement that Dial ‘has the full support of the Fraternal Order of Police as we continue to review the facts and circumstances surrounding this tragic incident.’
Philadelphia Mayor Jim Kenney called the death ‘a tragedy’ on Wednesday.
‘This is certainly a tragedy and my heart breaks for the family and for the loss of Mr. Irizarry,” Kenney told reporters.
Adding ‘the investigation will bring out whatever it’s going to bring out, and we’ll move on from there.’
